Bitnami IP Guidelines

1. Introduction and Scope

These Guidelines govern the use of the Bitnami software packages, stand-alone OCI container images, Helm charts including their dependent container images, and virtual machine images (collectively, "Bitnami Applications"), and associated intellectual property owned by Broadcom Inc. and/or its subsidiaries ("Broadcom").

Broadcom owns Bitnami and the Bitnami Trademarks, including the BITNAMI word mark and the Bitnami logo. Your use of Bitnami Stacks or Bitnami Trademarks (together, “Bitnami IP”) implies acceptance of these Guidelines. Broadcom reserves the right to revoke these permissions at any time. 

2. Software Usage and Redistribution

Permitted Use: You may download, deploy, and use open source Bitnami Stacks free of charge for personal or internal organizational use. Commercial applications included in Bitnami Stacks may be subject to limited-time trials and separate licensure. 

Redistribution of Unmodified Stacks: You may redistribute Bitnami Stacks only if they have not been modified in any way. 

Modification and Redistribution:

  • Personal/Internal Use: You may modify Bitnami Stacks for your own personal or internal organizational use.
  • External Redistribution: You may not redistribute modified versions of Bitnami Stacks associated with Bitnami Trademarks without express written certification from Broadcom.
  • Compliance for Modified Versions: If you redistribute a modified stack, you must remove all Bitnami Trademarks (logos, names) and recompile the source code to create your own binaries. Failure to do so misrepresents the software as an official Broadcom release and violates these Guidelines.

Prohibited Competitive Use: You may not use Bitnami IP to develop a competing service or catalog of services available outside your organization.

3. Trademark Usage

Broadcom grants a limited license to use Bitnami Trademarks solely as follows:

Prohibited Uses: You may not use Bitnami Trademarks in:

  • Internet domain names or URLs;
  • Merchandising or commercial goods;
  • Software titles; and/or
  • A manner that implies endorsement, certification, or affiliation with Broadcom.

Fair Use: You may use Bitnami Trademarks in discussion, commentary, criticism, or parody, provided you do not imply Broadcom’s endorsement.

Ownership and Goodwill: You acknowledge that Bitnami IP is the exclusive property of Broadcom. You agree that any goodwill derived from your use of the trademarks inures solely to the benefit of Broadcom and will be assigned to Broadcom upon request

Broadcom reserves the right to review all use of the Bitnami Trademarks and to object to any use that appears outside of the IP Guidelines.

4. Copyrights and Third-Party Rights

Broadcom Copyrights: Installer system images, packages, and binary files are the copyright of Broadcom and must be used in accordance with the licenses therein.

Third-Party Components: Bitnami Stacks contain third-party software (e.g., Amazon Web Services, Google Cloud Platform, Microsoft Azure, Oracle, Varnish, Artifactory). These trademarks are the property of their respective owners, and your use is subject to their individual trademark and licensing policies.

BITNAMI IP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. BROADCOM DOES NOT GUARANTEE THE PERFORMANCE OF MODIFIED VERSIONS.
